语篇信息视角下的中国法院调解说服实现研究(英文)
本书选取当前中国司法实践活动中备受关注的法院调解为课题,基于真实的当庭调解语料,建构了“语篇信息为中心的说服模式”DICMP分析法院调解中法官说服活动的话语实践过程。分析发现:法院调解的过程是一个说服的过程,是一个法官结合当事人的认知反应,激活、凸显说服语境中的影响因素,通过有效的语篇信息呈现方式传递说服意图,以缩小当事人之间的信息差,影响当事人的认知、态度或行为的过程。本书将为正在进行的法院调解改革提供语言学层面的参考,有助于实现法律语言学研究成果服务司法实践与改革的目的,为构建和谐社会做出应有的贡献。
